Abstract
The commercial fishing of abalone has been regulated in one form or another since the early 1970s. In the present day, commercial fishing for abalone in Western Australian waters is principally regulated by the Abalone Management Plan 1992 which is taken to have been made, and is in force, under the Fish Resources Management Act 1994 ("the Act").
The regulatory regime established by the Abalone Management Plan 1992 ("the Plan") is based upon the principle that in each year a specific quantity of abalone (often referred to as 'quota') is determined to be the 'allowable catch' for that year. This quantity of abalone is determined in accordance with the long-term sustainable management of the fishery. The 'allowable catch' is allocated to the licence holders by reference to units of entitlement.
A second governing principle is that licence holders must maintain a specified 'minimum unit holding' under their licences, due to concerns about the implications of enforcing the provisions of the law against a large number of minor operators.
In accordance with these principles of 'allowable catch' and 'minimum unit holdings', the Abalone Management Plan 1992 confers on the Executive Director discretionary functions that are directed at the dynamic and effective administration of the fishery.
